These Terms & Conditions (“Terms”) govern your use of the website theportaltours.com (“Website”) and all travel-related services offered by The Portal Tours & Management Services, based in Srinagar, Jammu & Kashmir (“TPTAMS”, “we”, “us”, “our”).
By accessing our Website, submitting an enquiry, or booking any service through us, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.
Note: These Terms work together with our separate Booking & Cancellation Policy and Privacy Policy. Please read all of them carefully before confirming any booking.
1. Definitions
For the purpose of these Terms:
“TPTAMS / we / us / our” – The Portal Tours & Management Services, its owners, employees, representatives, and authorised partners.
“You / Traveller / Guest / Client” – The person making an enquiry or booking, and all travellers included under that booking.
“Services” – Any travel-related service offered by TPTAMS, including but not limited to tour packages, hotel bookings, transport, sightseeing, activities, and support.
“Third-party supplier” – Any hotel, airline, transport provider, activity operator, or other vendor whose services are arranged by TPTAMS.
2. Scope of Services
TPTAMS acts as a tour organiser and travel facilitator. We design and coordinate travel itineraries and make bookings with various third-party suppliers on your behalf.
Our services may include:
Kashmir tour packages and experiences
Domestic tours within India
International holiday packages with selected partners
Hotel, transport, sightseeing, and related travel arrangements
We do not own or operate airlines, railways, hotels, or local transport services. These are operated by independent third parties.
3. Eligibility
By using our Website or services, you confirm that:
You are at least 18 years old and legally capable of entering into binding agreements; and
You are providing information on behalf of yourself and/or other travellers with their full consent.
If you are making a booking on behalf of others (family, friends, group), you are responsible for ensuring they understand and accept these Terms.
4. Use of the Website
You agree to use theportaltours.com only for lawful purposes and in a manner that does not:
Violate any applicable law or regulation
Infringe the rights of TPTAMS or any third party
Disrupt or damage the Website or its functionality
You also agree not to:
Attempt unauthorised access to any part of the Website
Use automated tools (bots, scrapers, etc.) to copy or extract data without our permission
Post or transmit harmful content, spam, or misleading information
We may suspend or restrict access to the Website at any time for maintenance, security, or misuse without prior notice.
5. Enquiries, Quotes & Bookings
Submitting an enquiry through our forms, WhatsApp, email, or phone does not create a confirmed booking.
We will review your requirements and share a proposed itinerary and quotation based on availability and current prices.
A booking is considered confirmed only after:
You accept the proposal in writing (email / WhatsApp), and
You pay the required advance amount, and
You receive a written confirmation / voucher / invoice from us.
All bookings are governed by our Booking & Cancellation Policy, which forms an integral part of these Terms.
6. Prices, Inclusions & Exclusions
Prices are generally quoted in Indian Rupees (INR) unless mentioned otherwise.
Package cost is based on the inclusions clearly listed in your final itinerary/quotation (e.g., type of hotel, meal plan, vehicle type, sightseeing, etc.).
Items not specifically mentioned as included will be treated as excluded, such as:
Flights, certain activities, entry fees, tips, personal expenses, extra meals, etc.
Prices are subject to change before confirmation due to:
Changes in tax, fuel prices, hotel or transport costs, currency fluctuations, or supplier revisions.
If any change affects your confirmed booking, we will inform you as early as possible and discuss available options.
7. Payments
Payment terms (advance amount, balance due date, etc.) will be clearly mentioned in your quotation or invoice.
Failure to pay the balance amount by the due date may result in cancellation of your booking, subject to cancellation charges.
Any bank charges, payment gateway fees, or transfer fees are to be borne by you unless specified otherwise.
8. Traveller Responsibilities
By booking with TPTAMS, you agree that:
All information you provide (names, ages, contact details, identity documents, etc.) is accurate and complete.
You and your co-travellers possess valid IDs, passports, visas, and permits as required for the trip.
You will comply with local laws, customs, hotel rules, and instructions from guides or drivers.
You are responsible for:
Your personal belongings and valuables
Your health, fitness, and ability to undertake the trip
Any damage or loss caused by you to property, vehicles, or hotels
TPTAMS is not responsible for consequences arising from incorrect information, lack of documents, or failure to follow guidelines.
9. Health, Safety & Special Requirements
If you have any medical condition, mobility limitation, or special requirement, you must inform us at the time of enquiry.
We will share options and limitations honestly, but we cannot guarantee special arrangements unless confirmed in writing.
You are responsible for carrying any personal medication, prescriptions, and health-related supplies during the trip.
Some destinations (e.g., high-altitude areas, snow zones, offbeat valleys) can be physically demanding or affected by weather. You are advised to assess your health and take professional medical advice if needed.
10. Third-Party Suppliers
Hotels, airlines, transport services, and activity operators are independent third parties.
TPTAMS selects suppliers in good faith but does not control their operations.
All services are subject to the terms and conditions, policies, and availability of the respective suppliers.
If a supplier fails to provide a service as promised due to their internal reasons, we will:
Assist you as far as reasonably possible, and
Try to arrange alternatives or refunds as permitted by that supplier.
We are not responsible for any act, omission, or negligence of third-party suppliers beyond our reasonable control.
11. Itinerary Changes, Delays & Force Majeure
Sometimes, itineraries may need modification due to:
Weather conditions (snow, rain, landslides, roadblocks)
Political or security situations
Transport delays (flights, trains, traffic, strikes)
Government restrictions or permits
Other events beyond our control (“force majeure”)
In such cases:
We may alter routes, sightseeing, hotels, or transport to ensure safety and feasibility.
We will try to keep the overall experience as close as possible to your original plan.
Any additional costs arising from such changes (extra nights, alternate routes, etc.) will be borne by the traveller, unless a supplier issues a refund or waiver.
12. Cancellations & Refunds
Cancellations, date changes, and refunds are governed by our Booking & Cancellation Policy and the individual policies of hotels, airlines, and other suppliers.
Different services may have different cancellation rules (e.g., non-refundable hotel rates, peak-season policies).
Some components (such as visas, permits, processing fees, and fully non-refundable bookings) may not be refundable at all.
Please read the Booking & Cancellation Policy carefully before confirming any trip.
13. Travel Insurance
TPTAMS strongly recommends that you purchase comprehensive travel insurance covering (as applicable):
Trip cancellation and curtailment
Medical expenses and emergency evacuation
Loss of baggage and personal belongings
Accidents and personal liability
We may share suggestions, but the choice and purchase of insurance is ultimately your responsibility.
14. Limitation of Liability
To the maximum extent permitted by law:
TPTAMS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit, revenue, or goodwill arising from the use of our services.
Our total liability, in any case, will not exceed the amount paid to us for the specific booking or service giving rise to the claim.
We are not responsible for:
Delays, cancellations, or changes by airlines, railways, hotels, or other suppliers
Loss, theft, or damage to personal belongings
Personal injury, illness, or death, except where caused directly by our proven negligence
Nothing in these Terms excludes any liability that cannot be excluded under applicable Indian law.
15. Intellectual Property
All content on our Website, including text, logos, graphics, images, and layouts, is the intellectual property of TPTAMS or used with permission.
You may not copy, reproduce, modify, or distribute any content from our Website without prior written consent, except for personal, non-commercial use related to your travel planning.
16. User Reviews & Feedback
You may share reviews, photos, or feedback about your experience with TPTAMS.
By submitting content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display this content on our Website, social media, or marketing materials, with or without your first name and city, unless you explicitly request otherwise.
You agree not to submit any content that is defamatory, offensive, misleading, or infringes third-party rights.
17. Privacy & Data Protection
We respect your privacy.
Any personal information collected through our Website, forms, WhatsApp, email, or phone is handled according to our Privacy Policy.
By using our services, you consent to the collection and use of your data as described in that policy.

18. Governing Law & Jurisdiction
These Terms are governed by the laws of India, and in particular, by the laws applicable in the Union Territory of Jammu & Kashmir.
Any dispute arising out of or in connection with these Terms, or any booking made with TPTAMS, shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir, India.

We may update or modify these Terms from time to time:
Any changes will be posted on this page with an updated “Last updated” date.
Continued use of our Website or services after such changes are posted will be deemed as your acceptance of the revised Terms.
